These Terms of Service ("Terms") govern your access to and use of our website, products, digital content, educational services, training programs, certifications and other services offered by Sugar Browed (collectively, the "Services").
By purchasing or using our Services, you agree to these Terms to the extent applicable to your use or purchase.
Nothing in these Terms excludes, restricts or overrides any mandatory rights available to consumers under applicable law.

3. ELIGIBILITY

Certain professional training programs, certifications, trainer programs, partnership programs, business services or other specific Services may be subject to additional minimum-age or eligibility requirements.
Where a particular Service requires participants to be at least eighteen (18) years old, this will be stated in the applicable product, booking or program information.
Sugar Browed may request reasonable age or identity verification where necessary.

Product and service availability may change.
Sugar Browed may modify, replace, update, suspend or discontinue products or services, subject to existing contractual obligations and applicable law.
5. PROFESSIONAL-USE PRODUCTS
Certain Sugar Browed products are designed primarily for trained beauty professionals, brow artists, salons, educators or other professional users.
Some products require appropriate knowledge, training, application techniques, hygiene procedures or safety precautions.
Where applicable, purchasers and users are responsible for:
- Reading and following product instructions;
- Observing warnings and safety information;
- Using products only for their intended purpose;
- Following appropriate hygiene practices;
- Ensuring that they possess any training or competence reasonably required for professional use;
- Complying with professional, licensing and regulatory requirements applicable in their jurisdiction.
Unless expressly stated otherwise, the ability to purchase a product does not constitute confirmation by Sugar Browed that the purchaser holds any particular professional qualification.
Nothing in this section excludes liability or consumer rights that cannot legally be excluded.
6. ORDERS
Placing an order constitutes an offer to purchase the selected products or services.
Receipt of an automated order confirmation does not necessarily mean that an order has been finally accepted where additional verification is reasonably required.
Sugar Browed may refuse or cancel an order where reasonably necessary, including where:
- A product is unavailable;
- Payment cannot be authorized;
- Incorrect pricing or product information has been displayed due to an obvious error;
- Fraud or unauthorized payment is reasonably suspected;
- Required customer information cannot be verified;
- Applicable legal or regulatory restrictions prevent fulfillment;
- Shipping to the destination is unavailable or legally restricted.
Where Sugar Browed cancels a paid order and no goods or services have been supplied, amounts paid for the cancelled portion will be refunded as required by applicable law.
7. PRICING
Prices are displayed in the currency indicated on our website or at checkout.
Prices may be changed for future purchases at any time.
Price changes do not retroactively alter a completed purchase unless required to correct an obvious error and applicable law permits the correction.
Where a clear pricing, typographical or technical error occurs, Sugar Browed may contact the customer before fulfillment to explain the error and, where legally permitted, offer the choice between proceeding at the correct price or cancelling the affected order.
Applicable taxes will be displayed or handled in accordance with the checkout configuration and applicable law.
For international orders, additional import charges may apply as described in our Shipping Policy.
8. PAYMENTS
By submitting payment information, you confirm that you are authorized to use the selected payment method and that the information supplied is accurate.
Payments may be processed by independent third-party payment providers.
Additional terms imposed by the selected payment provider may apply.
Sugar Browed may conduct reasonable fraud screening, payment verification, address verification or order validation before fulfillment.
Where additional verification is reasonably required, fulfillment may be temporarily suspended until verification is completed.
9. CUSTOMER ACCOUNTS
Certain Services may require or permit creation of an account.
Customers are responsible for:
- Providing accurate account information;
- Keeping login credentials confidential;
- Taking reasonable measures to prevent unauthorized access;
- Informing Sugar Browed of suspected unauthorized use.
Unless expressly authorized otherwise, accounts associated with purchased educational content are intended for use by the individual purchaser or registered student.
Accounts and individual course access may not be sold, transferred or intentionally shared with unauthorized third parties.
Sugar Browed may investigate unusual account activity where reasonably necessary to protect customers, digital content, intellectual property or platform security.
10. DIGITAL CONTENT LICENSE
Unless expressly stated otherwise, digital products, online courses, educational materials, videos, templates, workbooks and similar content are provided under a limited license rather than transferring ownership of the intellectual property.
Subject to these Terms, Sugar Browed grants the authorized purchaser a limited, non-exclusive, non-transferable license to access and use purchased digital content for its intended personal educational or internal professional purpose.
Except where permitted by applicable law or expressly authorized by Sugar Browed, customers may not:
- Copy;
- Reproduce;
- Republish;
- Distribute;
- Resell;
- License;
- Transfer;
- Upload;
- Broadcast;
- Share;
- Record;
- Circumvent access controls;
- Commercially exploit;
Sugar Browed digital content or substantial portions thereof.
Nothing in these Terms restricts rights that cannot lawfully be restricted.
11. LIFETIME ACCESS
Where Sugar Browed expressly advertises an online course or digital educational product as including "lifetime access," the purchaser will receive ongoing access in accordance with the offer made at the time of purchase.
"Lifetime access" does not mean that Sugar Browed guarantees that a particular third-party platform, software system or technical delivery method will exist indefinitely.
Sugar Browed may update, migrate or replace the platform or technical method through which content is delivered.
Where reasonably necessary to discontinue or materially change a lifetime-access product, Sugar Browed will take reasonable steps to preserve access or provide an appropriate alternative where required by the original offer and applicable law.
This section does not permit Sugar Browed to disregard contractual rights acquired by a customer at the time of purchase.
12. DIGITAL DELIVERY AND RIGHT OF WITHDRAWAL
Digital products and online educational content may be made available immediately following purchase.
Where EU consumer law applies, the statutory right of withdrawal for digital content may be lost after performance begins only where the legal requirements for such loss have been satisfied.
This may include, where required:
- The customer's prior express consent to immediate performance during the withdrawal period;
- The customer's acknowledgement that beginning performance results in loss of the right of withdrawal;
- The required contractual confirmation.
Sugar Browed may retain records relating to purchase, consent and digital access for the purposes of contract administration, legal compliance and dispute resolution.

13. INTELLECTUAL PROPERTY
Unless otherwise stated, the website and materials made available by Sugar Browed are owned by, licensed to, or otherwise lawfully used by Sugar Browed and are protected by applicable intellectual property laws.
Protected materials may include:
- Course materials;
- Videos;
- Educational systems;
- Training materials;
- E-books;
- Guides;
- Templates;
- Documents;
- Product photography;
- Graphics;
- Logos;
- Brand names;
- Trademarks;
- Website content;
- Marketing materials;
- Proprietary educational materials.
Purchasing a product or service does not transfer ownership of Sugar Browed intellectual property.
Unauthorized use may result in suspension of access and other remedies available under applicable law.
14. USER-GENERATED CONTENT
Where a customer voluntarily submits reviews, photographs, videos, testimonials, assignments or other content to Sugar Browed, ownership remains with the original rights holder unless separately agreed otherwise.
Submitting content through a feature intended for publication may grant Sugar Browed the limited rights reasonably necessary to display, operate or administer that feature, subject to the applicable submission terms and law.
Sugar Browed will not treat private customer-service photographs, videos, screenshots or support attachments as marketing content merely because they were submitted for customer support.
Separate permission may be requested where Sugar Browed wishes to use customer-created content for advertising, marketing or other promotional purposes.
15. PROHIBITED CONDUCT
Users may not use the Services to:
- Commit fraud;
- Provide knowingly false information in connection with a claim;
- Gain unauthorized access to systems or accounts;
- Circumvent security measures;
- Distribute purchased course materials without authorization;
- Share individual course accounts with unauthorized persons;
- Infringe Sugar Browed or third-party intellectual property rights;
- Misrepresent an affiliation, certification or partnership with Sugar Browed;
- Use Sugar Browed trademarks without authorization;
- Harass, threaten or unlawfully abuse employees, contractors, trainers, partners or other users;
- Use the Services for unlawful purposes.
Sugar Browed reserves all rights and remedies available under applicable law.
16. CERTIFICATIONS
Sugar Browed may issue certificates or certifications in connection with eligible educational programs.
Unless expressly stated otherwise, a Sugar Browed certificate confirms successful completion of the relevant Sugar Browed program or requirements.
It does not automatically constitute:
- A government-issued professional license;
- Regulatory authorization;
- Government accreditation;
- Permission to perform a regulated activity;
- A guarantee of professional competence;
- A guarantee of employment;
- A guarantee of business or financial results.
Students and professionals remain responsible for determining which licenses, permits, insurance, registrations or qualifications are legally required in their jurisdiction.
17. CERTIFIED SUGAR BROWED ARTISTS
Where Sugar Browed authorizes an individual to use a specific designation such as "Certified Sugar Browed Artist," that designation may only be used in accordance with the applicable certification rules.
Certification status is personal and may not be transferred to another individual or business without authorization.
Certification does not make an independent artist, salon or professional an employee, agent or legal representative of Sugar Browed.
18. CERTIFICATION SUSPENSION OR REVOCATION
Where reasonably justified, Sugar Browed may suspend or revoke certification status for serious violations including:
- Fraud;
- Falsification of certification;
- Unauthorized transfer of certification;
- Intellectual property infringement;
- Unauthorized use of Sugar Browed trademarks;
- Material misrepresentation of affiliation with Sugar Browed;
- Serious or repeated breach of applicable certification requirements;
- Conduct that creates a substantiated safety concern;
- Other material breaches of applicable certification terms.
Where appropriate in the circumstances, Sugar Browed may provide notice or an opportunity to respond before permanent revocation.
Any decision will remain subject to applicable contractual and mandatory legal rights.
19. ACCOUNT SUSPENSION AND TERMINATION
Sugar Browed may reasonably suspend, restrict or terminate access where necessary to:
- Protect account security;
- Prevent fraud;
- Investigate suspected account sharing;
- Protect intellectual property;
- Prevent unauthorized distribution;
- Enforce material contractual obligations;
- Comply with legal requirements.
Where circumstances permit, Sugar Browed may first request information or provide notice.
Immediate temporary suspension may be used where reasonably necessary to protect customers, systems, intellectual property or evidence while an issue is investigated.
Mandatory consumer and contractual rights remain unaffected.
20. RETURNS, REFUNDS AND CANCELLATIONS
Returns, refunds, statutory withdrawal rights and cancellations are governed primarily by our Return & Refund Policy and any specific terms applicable to the purchased Service.
Nothing in these Terms excludes mandatory statutory rights.
Where these Terms conflict with the Return & Refund Policy on a matter specifically concerning returns or refunds, the Return & Refund Policy applies to that matter.
21. IN-PERSON TRAINING
In-person training, private training, group training, masterclasses, workshops and similar scheduled educational services may be subject to separate Training Terms & Conditions.
Such terms may regulate matters including:
- Deposits;
- Payment deadlines;
- Rescheduling;
- Cancellation;
- Models;
- Arrival times;
- No-shows;
- Private training supplements;
- Certification requirements.
Customers should review the applicable training terms before booking.
Mandatory consumer rights remain unaffected.
22. PRODUCT SAFETY AND PATCH TESTING
Customers must read and follow applicable product instructions, warnings, storage requirements and safety information.
Where Sugar Browed instructions require a patch test, the patch test must be performed in accordance with the relevant instructions before use.
Individual sensitivities and allergic reactions may occur.
A successful patch test does not guarantee that an adverse reaction can never occur.
Products should not be used contrary to their instructions or intended purpose.
Professional users remain responsible for following applicable professional hygiene and safety standards.
23. HEALTH INFORMATION AND MEDICAL DISCLAIMER
Sugar Browed does not provide medical advice.
Customers with allergies, sensitivities, medical conditions, skin or eye conditions, pregnancy-related concerns or other health concerns should seek advice from an appropriately qualified healthcare professional where appropriate before using a product or undergoing a treatment.
Customers should discontinue use and seek appropriate assistance where an adverse reaction occurs.
Nothing in these Terms limits liability that cannot legally be limited.
24. EDUCATIONAL DISCLAIMER
Sugar Browed educational materials are intended to provide professional education and instruction within the scope described for the relevant course.
Individual outcomes vary.
Sugar Browed does not guarantee:
- Revenue;
- Profitability;
- Business success;
- Client acquisition;
- Employment;
- Specific treatment results;
- Licensing outcomes;
- Regulatory approval;
- Future commercial performance.
Students remain responsible for practice, professional judgment, local legal requirements and appropriate insurance or licensing where applicable.
25. INDEPENDENT CERTIFIED ARTISTS, TRAINERS AND OTHER THIRD PARTIES
Unless expressly stated otherwise, independent certified artists, salons, trainers, educators, affiliates, distributors and business partners operate independently.
Their independent services, pricing, scheduling, professional decisions and treatment performance are their own responsibility.
Certification or listing by Sugar Browed does not automatically create an employment, agency, franchise or partnership relationship.
Nothing in this section excludes responsibility that applicable law specifically places on Sugar Browed.
26. INTERNATIONAL SALES
Sugar Browed sells products and services internationally where operationally and legally possible.
Availability may vary by destination.
Sugar Browed may refuse or cancel an international order where:
- Delivery is unavailable;
- Import or export restrictions apply;
- Sanctions or trade restrictions apply;
- Carrier restrictions apply;
- Legal or regulatory concerns prevent fulfillment;
- Delivery is otherwise not reasonably possible.
Customers remain responsible for determining whether professional products or services may lawfully be imported, possessed or professionally used in their jurisdiction where this is reasonably within their responsibility.
27. CUSTOMS, DUTIES AND IMPORT CHARGES
International shipments may be subject to:
- Customs duties;
- Import taxes;
- VAT;
- Brokerage fees;
- Clearance fees;
- Storage fees;
- Inspection fees;
- Government charges;
- Other destination-country charges.
Unless expressly stated otherwise, international shipments are subject to the shipping terms described in our Shipping Policy.
Where applicable under those terms, import-related charges are the customer's responsibility.
Refusal to pay applicable import charges does not automatically create a right to a full refund.
Where a parcel is refused, abandoned, returned, unclaimed, confiscated or destroyed for reasons attributable to the customer, costs actually incurred may be deducted from any amount otherwise refundable to the extent permitted by applicable law.

28. SHIPPING AND DELIVERY
Processing times and delivery estimates are described in our Shipping Policy.
Delivery estimates are estimates and not guaranteed delivery dates unless expressly stated otherwise.
Customers are responsible for providing accurate and complete delivery information.
Customers should contact Sugar Browed as soon as possible after discovering an address error.
Once an order has been processed or dispatched, changes cannot be guaranteed.
Shipping delays, lost shipments, returned parcels and delivered-but-not-received claims will be handled in accordance with our Shipping Policy, Return & Refund Policy and applicable law.
29. CHARGEBACKS AND PAYMENT DISPUTES
Customers are encouraged to contact Sugar Browed at info@sugarbrowed.com if there is a problem with an order so that we have an opportunity to investigate and resolve the matter.
Nothing in these Terms prevents a consumer from exercising any lawful right to dispute a payment through a bank, payment provider or other competent mechanism.
Where a chargeback or payment dispute is initiated, Sugar Browed may provide relevant evidence to the payment provider where lawfully permitted, including:
- Order records;
- Transaction information;
- Shipping records;
- Tracking information;
- Delivery information;
- Customer communications;
- Course-access records;
- Account records;
- Relevant technical records.
Sugar Browed may contest fraudulent, duplicate, abusive or factually unsupported payment disputes and exercise available legal remedies.
30. FRAUD AND ABUSE
Sugar Browed may take reasonable and proportionate measures to investigate and prevent:
- Payment fraud;
- Identity fraud;
- False claims;
- Return abuse;
- Promotion abuse;
- Unauthorized account sharing;
- Piracy;
- Intellectual property infringement;
- Other misuse of the Services.
Measures may include verification requests, temporary account restrictions, cancellation of suspicious orders before fulfillment or other appropriate action permitted by law.
The lawful exercise of a statutory consumer right will not by itself be treated as fraud or abuse.
31. THIRD-PARTY SERVICES
Sugar Browed uses third-party services in operating its business, which may include:
- Ecommerce platforms;
- Payment providers;
- Shipping carriers;
- Logistics and fulfillment providers;
- Course platforms;
- Customer-service platforms;
- Email and communication providers;
- Analytics providers;
- Marketing platforms;
- Other technology providers.
Third-party services may experience interruptions, delays or technical issues outside Sugar Browed's reasonable control.
Where a third-party service is necessary for Sugar Browed to fulfill its contractual obligations, Sugar Browed will remain responsible to the extent required by applicable law.
Use of certain third-party services may also be governed by the provider's own terms or privacy notice.
32. PRIVACY
Personal information is processed in accordance with our Privacy Policy and applicable data protection law.
Our Privacy Policy explains, among other things:

- Why we process it;
- Legal bases for processing;
- Service providers and international transfers;
- Data retention;
- Customer privacy rights;
- Use of AI-assisted technologies.
33. ELECTRONIC COMMUNICATIONS
Sugar Browed may send electronic communications necessary to administer purchases, accounts and Services, including:
- Order confirmations;
- Payment information;
- Shipping updates;
- Account notifications;
- Course-access communications;
- Security notices;
- Customer-service communications;
- Legally required notices.
Marketing communications are governed separately by applicable consent and marketing rules.
Where legally permitted, electronic communications may satisfy requirements for communications to be provided in writing.
34. WARRANTIES AND STATUTORY CONFORMITY
Nothing in these Terms excludes any statutory warranty, conformity right, legal guarantee or other consumer protection that cannot legally be excluded.
For consumers, products and digital content remain subject to applicable mandatory conformity and consumer-protection requirements.
Any additional commercial warranty offered by Sugar Browed will be governed by the terms of that warranty and will not reduce mandatory statutory rights.
35. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
In particular, nothing in these Terms limits mandatory consumer rights or liability that cannot lawfully be excluded.
For business customers, and to the maximum extent permitted by applicable law, Sugar Browed will not be liable for indirect or consequential commercial losses such as:
- Loss of profit;
- Loss of revenue;
- Loss of anticipated savings;
- Loss of business opportunity;
- Business interruption;
where such losses are not recoverable under applicable law.
Any limitation of liability will be interpreted only to the maximum extent permitted by applicable law and in light of the nature of the customer, contract and claim.
36. BUSINESS CUSTOMER INDEMNITY
Where a customer purchases or uses Sugar Browed products or Services in a professional or business capacity, that business customer remains responsible for its own professional activities and compliance with applicable law.
To the extent permitted by applicable law, a business customer shall be responsible for third-party claims resulting directly from:
- Its unlawful use of Sugar Browed products or Services;
- Its infringement of third-party rights;
- Unauthorized distribution of Sugar Browed intellectual property;
- Treatments or professional services independently provided by that business customer;
- Material breach of these Terms.
This section does not apply to the extent that a claim results from Sugar Browed's own breach, negligence or other responsibility that cannot legally be excluded.
37. FORCE MAJEURE
Sugar Browed will not be responsible for delay or failure caused by circumstances outside its reasonable control to the extent permitted by applicable law.
Such circumstances may include:
- Natural disasters;
- Fire or flooding;
- Public health emergencies;
- Government or regulatory actions;
- Import or export restrictions;
- Customs actions;
- Strikes or labor disruption;
- Major transportation disruption;
- Utility outages;
- Cyberattacks;
- Internet or infrastructure failures;
- Armed conflict or civil unrest;
- Serious carrier or supplier disruption.
Where such an event materially affects an existing consumer contract, Sugar Browed will handle the affected order in accordance with applicable consumer law.
38. GOVERNING LAW
These Terms are governed by the laws of Spain.
If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under applicable law.
39. DISPUTE RESOLUTION AND JURISDICTION
Customers are encouraged to contact Sugar Browed first regarding disputes so that we can attempt to resolve the matter directly.
Customer Support:
For consumers, jurisdiction is determined in accordance with applicable mandatory consumer law.
Nothing in these Terms requires a consumer to bring proceedings exclusively in Málaga where applicable law provides otherwise.
For business-to-business relationships, and where legally permitted, disputes arising from these Terms will be subject to the competent courts of Málaga, Spain.
40. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or severed to the minimum extent necessary.
The remaining provisions will continue to apply to the extent permitted by law.
41. NO WAIVER
Failure by Sugar Browed to enforce a contractual right on one occasion does not automatically constitute a waiver of that right.
Any waiver applies only to the specific circumstances in which it is given unless expressly stated otherwise.
42. ASSIGNMENT
Customers may not transfer individual account access, course licenses, certifications or other personal contractual rights where those rights are expressly personal and non-transferable.
Any broader assignment restriction applies only to the extent permitted by applicable law.
Sugar Browed may transfer contractual rights or obligations as part of a legitimate business restructuring, transfer or succession where permitted by law and without reducing mandatory customer rights.
43. INDIVIDUAL EXCEPTIONS AND GOODWILL
Where Sugar Browed voluntarily provides a customer with:
- Compensation;
- Store credit;
- A discount;
- A free product;
- A replacement;
- A reshipment;
- A refund beyond legal requirements;
- Another goodwill resolution;
that individual resolution does not automatically amend these Terms or create an entitlement for other customers to receive the same resolution.
Mandatory legal rights are unaffected.
44. ENTIRE AGREEMENT
These Terms, together with the specific policies and contractual information applicable to a purchase, form the contractual framework between Sugar Browed and the customer concerning that purchase or Service.
Nothing in this section excludes pre-contractual information or other terms that applicable law requires to form part of the contract.
45. CHANGES TO THESE TERMS
Sugar Browed may update these Terms from time to time for future use of the Services and future purchases.
The current version and its "Last Updated" date will be published on our website.
Changes to these Terms do not retroactively remove contractual or statutory rights already acquired in relation to an existing purchase.
Where a material change affects an ongoing Service or contractual relationship and applicable law requires advance notice, consent or another procedure, Sugar Browed will follow the applicable legal requirements.
