SUGAR BROWED — TRAINING TERMS & CONDITIONS

These Training Terms & Conditions (“Training Terms”) apply to in-person training services offered by Sugar Browed.

They supplement Sugar Browed’s general Terms of Service and other applicable policies. By booking an in-person training, the person making the booking (“Student”) agrees to these Training Terms, subject to any mandatory rights provided by applicable law.

1. BUSINESS INFORMATION

2. SCOPE

These Training Terms apply to in-person training offered by Sugar Browed, including Brow Extensions Training, Brow Lamination Training and other physical training programs that Sugar Browed may offer from time to time.

Certain training programs may be subject to additional or specific conditions. Where specific terms are expressly presented for a particular training, those terms apply together with these Training Terms.

3. BOOKING AND CONFIRMATION

A training place is only reserved once the required payment or deposit has been successfully received and the booking has been accepted by Sugar Browed.

Training places are subject to availability.

The applicable training date, time, location, language, price, included materials and other booking details are those confirmed for the specific training purchased.

Students are responsible for reviewing their booking confirmation and notifying Sugar Browed promptly if they believe any information is incorrect.

4. DEPOSIT AND PAYMENT

Where a deposit payment option is offered, the standard training deposit is €150 unless a different amount is expressly stated for the applicable training.

The deposit reserves training capacity, planning and a place for the Student.

Any remaining balance must be paid in accordance with the payment instructions and deadline communicated by Sugar Browed for the specific booking.

The Student is responsible for ensuring that all required payments are made by the communicated deadline.

After the expiry or loss, where applicable, of any mandatory statutory withdrawal right, the deposit is generally non-refundable where the Student cancels the training.

Nothing in this section limits any mandatory consumer rights that cannot lawfully be excluded.

5. STATUTORY RIGHT OF WITHDRAWAL

Consumers who book training online or otherwise at a distance may have a statutory right of withdrawal under applicable consumer law.

Where such a right applies, the applicable statutory withdrawal period and conditions will be respected.

If a consumer expressly requests that performance of a service begins during an applicable withdrawal period, Sugar Browed may request any consent, acknowledgement or other confirmation required by applicable law.

Where a service has been fully performed during an applicable withdrawal period following the legally required request and acknowledgement, the statutory withdrawal right may cease in accordance with applicable law.

Nothing in these Training Terms is intended to remove or restrict a mandatory statutory withdrawal right.

6. CANCELLATION BY THE STUDENT

If a Student wishes to cancel a training, Sugar Browed should be contacted as soon as possible.

After the expiry or loss, where applicable, of any mandatory statutory withdrawal right, cancellation by the Student does not automatically entitle the Student to a refund of the €150 deposit.

Any payment made above the deposit will be handled in accordance with the circumstances of the cancellation, the applicable booking conditions, Sugar Browed’s policies and mandatory law.

A cancellation request does not itself constitute approval of a refund, credit, replacement training date or other compensation.

Any exception or goodwill arrangement must be expressly approved by Sugar Browed.

7. RESCHEDULING BY THE STUDENT

A Student who wishes to move a confirmed training to another date must contact Sugar Browed as soon as possible.

The standard rescheduling fee is €150.

Unless Sugar Browed expressly agrees otherwise in writing, the replacement training must take place within three months of the originally booked training date.

All replacement dates are subject to availability.

A requested date is not confirmed until Sugar Browed has expressly confirmed the new booking.

8. CHANGES WITHIN 72 HOURS

A request to cancel or reschedule within 72 hours before the scheduled start of the training does not entitle the Student to a free change of date.

The applicable rescheduling conditions and fee may apply unless Sugar Browed expressly approves an exception or mandatory law requires otherwise.

Students are therefore encouraged to contact Sugar Browed as early as possible if circumstances arise that may affect attendance.

9. NO-SHOW

A Student who fails to attend the confirmed training without an approved cancellation or rescheduling arrangement may be treated as a no-show.

A no-show does not automatically entitle the Student to:

A refund;
A free replacement training date;
Store credit;
Compensation;
Transfer of the booking to another training.

Any exception requires express approval from Sugar Browed.

Mandatory consumer rights remain unaffected.

10. LATE ARRIVAL

Students are responsible for arriving at the confirmed location on time.

A Student arriving more than 30 minutes after the scheduled start time may be treated as a no-show where the delay means that the training can no longer reasonably, safely or effectively be completed.

Sugar Browed may, at its discretion, allow participation where this remains reasonably possible.

Allowing late participation on one occasion does not create a right to the same exception in another case.

11. TRAINING LOCATION, DATE AND TIME

The applicable location, training date and start time will be communicated in the booking information or confirmation.

Students are responsible for arranging their own transportation and arriving at the correct location on time.

Unless expressly stated otherwise, travel, accommodation, parking, visa costs, meals and other personal expenses are not included in the training price.

12. TRAVEL AND ACCOMMODATION

Students are encouraged not to make non-refundable travel or accommodation arrangements until their training has been confirmed.

Sugar Browed is not automatically responsible for independent travel, accommodation or other third-party expenses incurred by a Student if a training needs to be changed, postponed or cancelled.

Any responsibility will be determined in accordance with the applicable contract and mandatory law.

13. CANCELLATION OR RESCHEDULING BY SUGAR BROWED

Sugar Browed may occasionally need to reschedule, relocate or cancel a training because of circumstances affecting the trainer, location, safety, operations or ability to provide the training as planned.

Where reasonably possible, Sugar Browed will attempt to offer a suitable alternative date or other appropriate solution.

If Sugar Browed ultimately cannot provide the purchased training and no suitable alternative arrangement is agreed, any applicable contractual and statutory refund rights will be respected.

Nothing in these Training Terms excludes rights that cannot lawfully be excluded.

14. CIRCUMSTANCES OUTSIDE REASONABLE CONTROL

Training may occasionally be affected by circumstances outside Sugar Browed’s reasonable control, including serious illness, emergencies, government measures, extreme weather, transport disruption, infrastructure failures, venue problems or other exceptional circumstances.

Where reasonably possible, Sugar Browed may offer an alternative date, location or other appropriate solution.

Mandatory consumer rights remain unaffected.

15. TRAINING CONTENT

Training content depends on the specific training program purchased.

The applicable training page, booking information and confirmed offer determine matters such as:

Training subject;
Duration;
Techniques covered;
Practical components;
Included materials;
Starter Kit, where applicable;
Online course access, where applicable;
Certificate eligibility;
Other included benefits.

Students should not assume that all Sugar Browed training programs contain the same modules, materials, duration or techniques.

Sugar Browed may make reasonable educational or operational adjustments that do not materially reduce the purchased training service.

16. STARTER KITS AND MATERIALS

Where a Starter Kit, products, tools or other materials are expressly included in the purchased training, they will be provided in accordance with the applicable training offer.

Exact kit contents may depend on the training purchased and the offer applicable at the time of booking.

A Student should not rely on kit contents from an older advertisement, previous training or another Student’s booking.

Where substitutions are reasonably necessary, Sugar Browed will ensure that any substitute remains appropriate for the intended training purpose, without affecting mandatory consumer rights.

17. ONLINE COURSE ACCESS

Where an in-person training expressly includes access to a corresponding Sugar Browed online course, that access will be provided according to the offer applicable to the Student’s booking.

Where lifetime access was expressly included in the purchased offer, temporary technical issues, platform changes or account-access problems do not by themselves mean that the Student’s contractual access has expired.

Sugar Browed may use different platforms or technical systems to provide digital access where reasonably necessary.

18. CERTIFICATES AND CERTIFICATION LEVELS

Sugar Browed distinguishes between different certification levels.

A Student who successfully completes an eligible training may receive a:

Sugar Browed Certificate of Completion

A Certificate of Completion confirms completion of the applicable Sugar Browed educational program and its required course components.

It is not the same as:

Sugar Browed Professional Certification

Professional Certification is a separate level that requires additional practical assessment, review and approval by Sugar Browed.

Completion of a training or receipt of a Certificate of Completion does not automatically grant Professional Certification.

Professional Certification does not automatically grant Certified Salon, Certified Artist, Trainer, Partner or other separate Sugar Browed status unless the applicable requirements for that status have also been satisfied.

Sugar Browed certificates and certifications are not automatically government-issued professional licences, regulated qualifications or statutory authorisations.

Students are responsible for checking any local professional or legal requirements applicable to their activities.

19. PRACTICAL PARTICIPATION

Students are expected to participate professionally and follow reasonable instructions given by the trainer.

This includes instructions concerning:

Hygiene;
Safety;
Product use;
Treatment protocols;
Models;
Tools and equipment;
Practical exercises;
Training-room conduct.

Sugar Browed may restrict or stop a practical activity where continuing would, in Sugar Browed’s reasonable assessment, create an unnecessary safety risk for the Student, model, trainer or another person.

20. MODELS

Depending on the applicable training, practical work may require a suitable model.

Students may bring their own suitable model where permitted for the applicable training.

Where Sugar Browed offers to arrange a model, the current standard model fee is €50 unless otherwise stated.

Model arrangements are subject to availability and confirmation.

A model arranged by Sugar Browed is not considered confirmed until Sugar Browed has confirmed the arrangement.

Models must be at least 18 years old unless Sugar Browed expressly establishes a different lawful requirement for a particular training.

Students and models must follow the applicable safety, hygiene, patch-testing and treatment protocols.

21. SAFETY AND SUITABILITY

Students must follow the approved Sugar Browed protocols and product instructions applicable to the treatment being taught.

Where a patch test is required under the applicable Sugar Browed protocol, the Student is responsible for ensuring that the requirement is followed for their own model unless Sugar Browed has expressly taken responsibility for arranging it.

Students must not improvise chemical processing times, dosages, product combinations or other professional treatment instructions contrary to the approved training protocol.

A trainer may refuse or discontinue a practical treatment where there is a reasonable safety or suitability concern.

22. STUDENT CONDUCT

Sugar Browed aims to maintain a professional, respectful and safe learning environment.

Students must not engage in behaviour that is:

Threatening;
Abusive;
Harassing;
Discriminatory;
Intimidating;
Dangerous;
Seriously disruptive;
Fraudulent;
Deliberately damaging to property or equipment.

In serious circumstances, Sugar Browed may require a Student to leave or may terminate participation in the training.

Any financial consequences of termination will be assessed according to the circumstances, applicable contract terms and mandatory law.

23. PHOTOGRAPHY, FILMING AND RECORDING

Sugar Browed’s in-person training contains proprietary educational content, practical demonstrations, methods and materials.

To protect Sugar Browed’s intellectual property, the privacy of participants and the quality of the training environment, Students are not permitted to photograph, film, audio-record, screen-record or otherwise reproduce the training unless Sugar Browed has expressly permitted the specific recording.

Recording the full training is strictly prohibited.

Recording substantial portions of the training is strictly prohibited.

Students may not record instructional explanations, demonstrations, presentations, course materials or practical teaching simply for later reproduction or review.

Student-created photography or video is permitted only at moments expressly allowed by the trainer.

This will generally be limited to permitted content such as before-and-after photographs or videos of the Student’s own practical work or model.

Permission to create before-and-after content does not grant permission to:

Record the trainer’s instruction;
Record demonstrations without permission;
Record other Students;
Record other models;
Reproduce training materials;
Film the complete treatment lesson;
Publish proprietary Sugar Browed educational content.

Any permitted recording must respect the privacy, consent and image rights of all persons appearing in the content.

Sugar Browed may itself photograph or record parts of a training for educational, internal or content purposes, subject to applicable privacy and image-right requirements.

Where appropriate and available, Sugar Browed may provide Students with selected photographs or video footage created by Sugar Browed.

Students should therefore not record instructional portions of the training themselves.

Unauthorized recording, reproduction, publication, distribution, sale or commercial exploitation of Sugar Browed training content may constitute a breach of these Training Terms and may also infringe applicable intellectual property or other rights.

24. INTELLECTUAL PROPERTY

Training materials and content provided by Sugar Browed may be protected by copyright, trademark, database, design and other intellectual property rights.

Protected materials may include:

Manuals;
E-books;
Presentations;
Videos;
Photographs;
Training demonstrations;
Worksheets;
Templates;
Course materials;
Methods and educational structures;
Certification materials;
Brand assets;
Marketing materials;
Other original content.

Purchasing or attending a training does not transfer ownership of these intellectual property rights.

Unless expressly authorized by Sugar Browed or permitted by applicable law, Students may not reproduce, republish, distribute, sell, sublicense, commercially exploit or share protected Sugar Browed training materials with unauthorized third parties.

Participation in a Sugar Browed training does not authorize a Student to copy the training and teach it to others as a Sugar Browed training.

Separate written authorization is required for any Sugar Browed Trainer, Academy, Partner or similar status.

25. PHOTOGRAPHY AND CONTENT CREATED BY SUGAR BROWED

Sugar Browed may wish to create photographs or video content during a training.

Where applicable law requires consent for the recording or commercial use of a Student’s or model’s identifiable image, Sugar Browed will obtain the appropriate consent.

Attendance at a training does not by itself constitute unlimited permission for Sugar Browed to commercially use a Student’s or model’s identifiable image.

Any separate content release, model release or media consent remains subject to its own terms.

26. TRAINING RESULTS

Sugar Browed provides professional education and practical instruction but cannot guarantee that every Student will achieve the same level of skill, speed, confidence or practical result after a single training.

Professional development depends on factors including:

Practice;
Individual skill;
Experience;
Technique;
Compliance with protocols;
Product knowledge;
Continued education;
Individual circumstances.

Sugar Browed does not guarantee any specific:

Income;
Revenue;
Number of clients;
Return on investment;
Business growth;
Social media growth;
Employment outcome.

27. LOCAL PROFESSIONAL REQUIREMENTS

Beauty-industry requirements can differ between countries, regions and professions.

Students are responsible for determining whether local law requires any additional:

Licence;
Registration;
Qualification;
Insurance;
Professional authorisation;
Hygiene certification;
Business permit;
Other legal requirement

before providing a treatment professionally.

A Sugar Browed certificate does not replace a statutory licence or government authorisation where one is legally required.

28. COMPLAINTS

If a Student has a complaint concerning a training, they should contact Sugar Browed as soon as reasonably possible and provide sufficient information for the matter to be investigated.

Depending on the circumstances, Sugar Browed may request relevant supporting information.

The submission of a complaint does not automatically entitle the Student to:

A refund;
Partial refund;
Free replacement training;
Store credit;
Compensation;
Other financial remedy.

Each complaint will be assessed according to the circumstances, the applicable agreement, Sugar Browed policies and mandatory law.

29. REFUNDS, CREDITS AND EXCEPTIONS

Refunds, partial refunds, credits, free rescheduling, compensation or other exceptions are not automatically granted simply because they are requested.

Any discretionary exception must be expressly approved by an authorized Sugar Browed decision-maker.

Nothing in this section limits a refund or other remedy that a consumer is legally entitled to receive under mandatory law.

30. GOODWILL DOES NOT CREATE PRECEDENT

Sugar Browed may occasionally provide a discretionary goodwill solution in an individual case.

Such a solution does not amend these Training Terms and does not create an automatic entitlement for another Student or future booking.

A previous exception should not be interpreted as a permanent policy change unless Sugar Browed expressly publishes it as such.

31. RELATIONSHIP WITH OTHER SUGAR BROWED TERMS

These Training Terms should be read together with the other applicable Sugar Browed terms and policies, which may include:

Terms of Service;
Privacy Policy;
Return & Refund Policy;
Purchase Options Cancellation Policy;
Relevant course or digital-content terms;
Any specific conditions displayed for the purchased training.

Where a specific training offer contains additional terms, those terms apply to that offer to the extent they are consistent with mandatory law.

If any contractual provision conflicts with a mandatory consumer right that cannot lawfully be excluded, the mandatory legal right prevails.

32. PERSONAL DATA

Personal information relating to training bookings, Students, models, payments, communications and course access will be processed in accordance with the Sugar Browed Privacy Policy and applicable data protection law.

Students should not unnecessarily provide sensitive personal information through public social-media channels.

33. CHANGES TO THESE TRAINING TERMS

Sugar Browed may update these Training Terms where reasonably necessary to reflect changes to its training programs, operations, services, technology or applicable legal requirements.

The current version will be published with an updated “Last Updated” date.

Changes will not be used retroactively to remove contractual or statutory rights already acquired in connection with an existing booking.

Where an earlier version of the Training Terms forms part of an existing booking, that version may remain relevant to the booking.

34. GOVERNING LAW

These Training Terms are governed by the laws of Spain.

Where a consumer resides in another jurisdiction and mandatory consumer law provides protections that cannot contractually be excluded, those protections remain unaffected.

35. JURISDICTION

For consumers, jurisdiction will be determined in accordance with applicable mandatory consumer law.

Nothing in these Training Terms requires a consumer to submit a dispute exclusively to the courts of Málaga where applicable law provides otherwise.

For business-to-business matters, where legally permitted, disputes relating to these Training Terms will be subject to the competent courts of Málaga, Spain.
